Frequently Asked Questions

The Building Energy Performance Standards (BEPS) are statewide regulations requiring large buildings to reduce energy use and emissions over time. BEPS aims to achieve Maryland’s climate goals of 60% GHG reduction by 2031 and net-zero by 2045.

All commercial and multifamily buildings 35,000 sq ft or larger must benchmark energy performance and meet phased reduction standards. Exemptions include historic properties, schools, manufacturing, agriculture, and federal buildings.

First benchmarking report: September 30, 2025
Annual reporting thereafter: June 1 each year
First emissions target period: 2030–2034
Final net-zero target: 2040+

Non-compliance may result in financial penalties through the Alternative Compliance Payment system, based on excess emissions over the standard. Benchmarking failures may also trigger enforcement actions and late fees.
